
This Blog has its roots in a perpetual intellectual disturbance, a contemporary constitutional disaster and a recurring inspiration. The perpetual intellectual disturbance is captured by the foundational question as to whether democratic constitutionalism and independence of the judiciary are theoretically and practically possible in a country like Pakistan. This perpetual intellectual disturbance has its immediate cause in the recent enactment of the Pseudo Constitution (Twenty-sixth Amendment) Act, 2024, and Constitution (Twenty-seventh Amendment) Act, 2025, which has destroyed any notion of democratic constitutionalism and independence of the judiciary in Pakistan. But this does not lead to despair, disillusionment and surrender because of the recurring resistance by the people of Pakistan including the lawyer’s community and a substantial minority of independent judges, providing a formidable dam against such attempts to abolish democratic constitutionalism and the independence of the judiciary in Pakistan. This Blog investigates and documents these three interconnected themes.
